Your Disability Is Supposed To Prevent You From Going To School

Just because youre in a wheelchair does not mean that you shouldnt be able to go to class, especially since all schools should be wheelchair-accessible. However, you may be collecting SSDI benefits based on certain conditions that shouldnt make it possible for you to attend class.

For example, if you have a social anxiety disorder thats bad enough to qualify you for SSDI benefits, then it should also be bad enough to prevent you from being able to attend a class where youll be surrounded by other people.

Again, your SSDI benefits wont be automatically suspended in a case like this. Youll need to explain to the Social Security Administration how you are managing to go to school despite your disability.

For example, maybe you can take online classes instead of showing up in person. Or, youre taking night classes, where there simply arent as many students present.

How Many Americans Had Their Social Security Payments Garnished

According to data from the Government Accountability Office, around 114,000 borrowers aged 50 and above had their Social Security payments garnished in 2015. The population of people aged 50 to 64 in this situation increased by 407% from 2002 to 2015, and it increased 540% for those aged 65 and older.

Wage garnishments are on the rise, too. According to a Student Loan Hero study based on Department of Education data, wage garnishment is becoming increasingly common for student loan defaulters. In the period between July 2015 and September 2018 the three-year period reviewed in the study debt collectors took $2.3 billion in wage garnishments.

How Student Earnings Affect The Monthly Ssi Benefit Amount

Students often need to work while they are in school to help defray their school expenses, either summer employment or part-time work during the school term. Generally, earned income from a job will reduce a personâs monthly SSI benefit. There are specific rules that apply to students regarding how earnings affect the SSI benefit. These rules are referred to as Student Earned Income Exclusions and are more generous than the rules that apply to non-students.

To understand the SEIE rules, it is helpful to first review how earnings affect a non-studentâs SSI benefit amount. If a SSI recipient has earned income from a job or self-employment, SSI excludes $65 plus one-half of the remaining earnings, together with an additional general income exclusion of $20. The remaining countable earnings will reduce the monthly SSI amount.

To illustrate, if Tom receives SSI and earns $615 in the month of January, this is how his earned income will affect his SSI:

How Getting A Degree Or Certificate Can Affect Ssi Eligibility

If your school attendance earns you a degree or diploma or a trade certificate, you will have the advantages that the new work qualifications give you. Those new qualifications will be considered the next time your claim undergoes a continuing disability review to see whether or not you are still disabled. If new occupations become suitable for you because of your new education and you can do those occupations with your physical and/or medical limitations, your benefits could end because you are no longer disabled. This should not scare you off from getting more education if your goal is to re-enter the workforce and have the broader life than being self-supporting can afford.

    A Scholarship Recipient Offers Advice

Abigail Brewer;is a sophomore at Liberty University in Lynchburg, VA. She is studying Teaching English as a Second Language with the intention to work as an ESL instructor. Abigail is a 2017 recipient of the Anders Tjellström Scholarship from Cochlear.

A My biggest struggle as a college student with hearing loss is being open with my friends. I can cover my hearing aid with my hair, so I often find it easier to pretend like I dont have any hearing loss instead of being real with those around me. However, I have learned over the past semester that my friends dont mind that I struggle with hearing loss. They appreciate me for who I am, and my hearing loss doesnt affect their perception of me as a person. Once I discovered that I could confidently live life with my hair up, my view of myself changed, and I began to trust others with my story as well.

A The scholarship from Cochlear will definitely open up many opportunities for me. The scholarship provides more than just a financial blessing, for it also gives me a chance to share my story with other students. It is such a blessing to know that I will have additional money for books, housing, and tuition during my college years, and I hope to save some of the money as well. The scholarship from Cochlear gives me an opportunity to dream big dreams about what I can do for others both now and in the future, and I am thrilled to have this opportunity.

The Degree You Are Pursuing Shouldnt Be Possible Because Of Your Disability

This is usually the case with trade schools. If youre collecting SSDI benefits because of a bad back and youre going back to school to learn a trade that requires physical labor, such as becoming an electrician, the Social Security Administration is going to assume that your disability must no longer be bad enough to prevent you from being able to work.

Essentially, it will depend greatly on what you are going back to school for. If you suffer from seizures that prevent manual labor but are going back to school to become a psychologist, then you should be okay.

Benefits For College Students With Deceased Parents

While most college students who have lost one or both parents are ineligible for Social Security benefits while in school, they may qualify for other benefits. There are numerous scholarship and grant opportunities available for children who have lost a parent, although the child must apply for such college payment assistance. Some scholarships are earmarked for the children of parents who died from certain causes, including cancer, a job-related injury or active-duty military service. Many state scholarships are available for students whose late parent was a member of the U.S. armed forces or served as a firefighter or police officer. Often, students are eligible for more than one of these types of scholarships. Search online for these scholarships and grants or contact your colleges financial aid office.

    • ABLE Accounts: The 2014 ABLE Act created ABLE Accounts. It permits eligible individuals and their families to set up tax-advantaged ABLE savings accounts that will not affect their eligibility for public benefits such as SSI and Medicaid. If an individual became disabled before 26 and currently receives SSI or SSDI benefits, they are eligible to set up an ABLE account.
    • Special Needs Trusts: Lets say you are an SSI recipient and someone gives you $15,000 to pay for college. That gift could disqualify you from further benefits due to the value limit on assets. A Special Needs Trust allows your benefactor to leave the money in a trust instead of giving it directly to you. Since you have no control over the funds, the trust property will not affect your SSI eligibility.
    • Pell Grants: These grants are intended for those in financial need. The U.S. Department of Education determines eligibility by taking the applicants financial information . They then input it into a certain formula to generate the Expected Family Contribution . They compare the EFC to the anticipated cost of college to determine the amount of financial aid.
    • Other Sources: Financial assistance received under Title IV of the Higher Education Act are also not treated as either income or resources for SSI purposes. They include the Federal Family Education Loan, the Federal Perkins Loan, the Academic Competitiveness Grant, National SMART Grant and the Federal Supplemental Educational Opportunity Grant.

Suspension Of Collection Activities During The Application Process

If you notify the Department that you plan on applying for a disability discharge, the Department will tell your loan holders to suspend collection activity for up to 120 days. So, you won’t have to make payments for up to 120 days, which gives you time to complete and submit the discharge application. After you submit your application, the Department will contact your loan holders and tell them to suspend collection activity on your loans for, again, up to 120 days.

The suspensions don’t apply to wage garnishments or Treasury offsets, however. But if the Department approves your request for a discharge, the wage garnishments or tax offsets will be discontinued.
